Construction Practice Group

Helping our clients construct a better California

A complex assortment of legal issues accompanies each phase of a construction project – from conception through closeout.  Timely, smart resolution of these issues preserves not only your profits, but also your important business relationships.

The attorneys in McDonough Holland & Allen’s Construction practice group focus their professional activities on the law and the business of the construction industry – helping you minimize liability and disputes.

Our construction lawyers advise and represent companies in most sectors of the construction industry – including general contractors, subcontractors, public agencies, private owners, construction managers, suppliers and sureties.

Our lawyers appear before a broad range of state and federal courts, as well as relevant administrative tribunals and boards of contract appeals.  We offer contract review and negotiation, mediation, arbitration and litigation services for all types of projects.

Our services include:

  • Preparation, review, counseling and negotiation of contract documents, including bid forms and contract procedures
  • Bid protest and award disputes involving issues of responsiveness, responsibility, disadvantaged business enterprise compliance and subcontractor listing requirements
  • Insurance requirements and disputes
  • Surety bond claims, performance bond disputes and surety take over agreements
  • Employment law issues, including prevailing wage matters, employee handbooks and wrongful termination
  • Payment disputes, including specialized remedies such as mechanic’s lien, payment bond and stop notice rights
  • Construction claim preparation and defense, including claims for delay, disruption, acceleration, differing site conditions and wrongful termination
  • Dispute resolution of performance issues through mediation, arbitration, litigation, administrative proceedings and negotiation
  • Contractor’s license law matters
  • Prosecution and defense of errors and omissions claims against design professionals

Construction law is constantly changing.  To keep current, we closely monitor federal, state and local legislative and regulatory activity concerning the construction industry.  Because of our involvement at this level, we were the first California firm invited to join the State Capital Global Law Firm Group.

Our construction lawyers are supported by our Real Estate practice group as well as our Business Services, Employment, and Public Law groups.  For the technical analysis and evaluation of claims, we engage outside consultants who specialize in scheduling, cost estimating, construction processes, engineering and accounting.

Our construction attorneys participate in the construction industry through a wide range of construction law and trade associations.  We speak at industry conferences and publish articles in trade publications on legal issues of interest to our clients.  For the memberships and activities of specific lawyers, please see attorney biographies.

Our legal advice can help you construct a better California.
